TERMS OF SERVICE

1.1 Introduction

These Terms of Service (“Terms”) govern the use of services provided by [Your Company Name] (“the Agency”, “we”, “us”, “our”), an introductory care agency providing non-clinical care introduction and coordination services.

By engaging our services, clients (“Service Users”, “Families”, “Care Recipients”) and carers agree to these Terms.

1.2 Nature of Service

We operate as an introductory and coordination service only. We:

Introduce clients to independent carers or care providers
Facilitate communication between parties
Assist with scheduling and care planning coordination

We do NOT:

Employ carers directly (unless explicitly stated)
Provide medical, nursing, or clinical services
Accept liability for care delivered by independent carers

All care decisions remain the responsibility of the client and/or their legal representative.

1.3 Contracts Between Parties

Any care agreement is strictly between the client and the independent carer unless otherwise stated in writing.

The Agency is not a party to that contract unless expressly agreed.

1.4 Fees

We may charge:

Placement or introduction fees
Administrative or coordination fees
Membership or subscription fees (if applicable)

All fees will be clearly disclosed in advance and are payable as agreed.

1.5 Limitation of Liability

To the fullest extent permitted by law:

We are not liable for acts, omissions, negligence, or misconduct of independent carers
We are not responsible for injury, loss, or damage arising from care services
We do not guarantee availability or suitability of any carer

1.6 Safeguarding

We may conduct reasonable vetting of carers; however:

Final responsibility for suitability rests with the client
Clients should carry out their own due diligence where appropriate

1.7 Termination

We reserve the right to:

Suspend or terminate services at any time for breach of Terms
Refuse service where safeguarding concerns exist

1.8 Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to Irish courts.
